For the purposes of these Terms, the following definitions apply:
“Tiidon” refers to our brand and service platform (accessible at tiidon.com), including Tiidon Innovations Limited (the registered business in Zambia, “Head Office”), Tiidon Cloud Limited (registered in the United Kingdom), and our affiliated entities in the United Arab Emirates (Dubai) and Nigeria (collectively, the “Tiidon Group”).
“Service” means the Tiidon web‑based website builder, Android app launchpad, associated APIs, templates, themes, hosting infrastructure, QR code generator, payment pages, and any additional features or support materials provided by the Tiidon Group.
“User” or “you” means any individual or legal entity that registers for, accesses, or uses the Service, whether on a free trial or under a paid subscription.
“Account” means the unique user profile, credentials, and associated settings you create when you register to use the Service.
“Content” means any text, images, video, audio, data files, designs, code, or other materials that you upload, submit, create, or otherwise make available through the Service.
“Subscription” means a paid plan—Growth, Professional, or Enterprise—with specified billing cycle (monthly or annual), fees, and feature entitlements as described on our Pricing Page.
“Free Trial” means the 14‑day evaluation period during which new Users can access paid features without charge, subject to these Terms.
“Downtime” means any period when the Service is unavailable or degraded due to scheduled maintenance or unexpected outages, as determined by Tiidon’s monitoring systems.
“Data Protection Laws” means all applicable data privacy and protection legislation, including Zambia’s Data Protection Act, the UK GDPR, the EU GDPR, the UAE’s DIFC and ADGM regulations, Nigeria’s NDPR, and any other relevant laws where Tiidon processes personal data.
“Affiliate” means any entity that directly or indirectly controls, is controlled by, or is under common control with Tiidon Innovations Limited, where “control” means ownership or voting interest of more than 50% or the power to direct management and policies.
“Governing Law” means, to the extent permitted by mandatory local provisions, the laws of Zambia, with Tiidon retaining the right to bring or defend any action in courts of Zambia, the United Kingdom, the United Arab Emirates, or Nigeria, at its discretion.
By accessing, browsing, registering for, or using any part of the Service—including Tiidon.com, the web application, mobile app, APIs, or any ancillary tools—you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. You further agree that:
You are at least eighteen (18) years of age or, if younger, have obtained parental or guardian consent to use the Service.
Your use of the Service complies with all applicable laws, regulations, and these Terms.
Tiidon may modify these Terms at any time by posting the revised version at tiidon.com/terms. Material changes will be communicated via email and/or in-app notifications at least thirty (30) days before they take effect. Your continued use after the effective date constitutes your acceptance of the updated Terms.
If you do not agree to any changes, you must discontinue use of the Service and cancel any active Subscription before the new Terms take effect.
To use the Service, you must meet the following eligibility requirements:
You are at least eighteen (18) years of age or, if under 18, you have obtained valid parental or guardian consent to enter into these Terms and use the Service.
You have the legal capacity to form a binding contract under the laws of your jurisdiction (Zambia, UK, UAE, Nigeria, or other applicable territory).
You are not a person or entity barred from receiving services under the laws of Zambia, the United Kingdom, the United Arab Emirates, Nigeria, the European Union, the United States, or any other applicable jurisdiction.
If you represent an organization or business, you warrant that you have authority to bind that entity to these Terms and all obligations herein.
In order to access paid features and manage your Subscription, you must register for an Account. When registering:
Accurate Information: You agree to provide true, accurate, and complete information during registration and to keep your profile updated (e.g., name, email, company).
Unique Credentials: You must choose a unique username and a secure password. Do not share these credentials with anyone.
Account Security: You are solely responsible for all activity that occurs under your Account. Immediately notify Tiidon of any unauthorized use or security breach at security@tiidon.com.
Email Verification: Tiidon may require email address verification to activate certain features. You must have access to the email account you register with.
Age and Authority: You represent that you are either an individual of legal age (18+) or, if registering on behalf of an organization, that you have authority to bind that organization to these Terms.
Account Suspension or Termination: Tiidon reserves the right to suspend or terminate your Account if you provide false information, violate these Terms, or engage in fraudulent or abusive behavior.
Plans: Tiidon offers three tiers—Growth, Professional, and Enterprise—each with defined feature sets and usage limits, as detailed on our Pricing Page.
Fees & Currency: Subscription fees may be displayed and billed in one of several currencies depending on your location—United States Dollars (USD), Zambian Kwacha (ZMW), Nigerian Naira (NGN), British Pounds Sterling (GBP), or Euro (EUR). Annual subscriptions receive a 20% discount off the equivalent monthly rate.
Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle. To avoid renewal, cancel via your Account Settings at least 48 hours before the renewal date.
Payment Methods: We accept multiple payment options:
Major credit and debit cards (Visa, MasterCard, American Express, Discover).
PayPal.
Local gateways: Flutterwave, DPO (Direct Pay Online), and Lenco.
Bank transfers (Enterprise only; contact sales).
Authorization: By enrolling in a paid plan, you authorize Tiidon to charge your selected payment method for all applicable fees, in your chosen currency, plus any local taxes and transaction fees.
Late Payments & Suspension: If payment fails or is not received within 7 days, Tiidon may suspend your access to paid features. After 30 days of non-payment, your account may be terminated and data deleted per our retention policy.
Invoicing & Receipts: A receipt or invoice will be emailed for each successful payment. Enterprise customers may request custom invoicing terms via billing@tiidon.com.
Free Trial Period: All new Users are eligible for a 14‑day free trial of the Growth or Professional plan. No credit card is required to start the trial, and you can upgrade at any time during the trial.
Trial Conversion: At the end of the 14‑day trial, you will be prompted to enter payment details to continue using paid features. If you do not subscribe, your account will revert to Growth’s free tier (limited to published sites/apps and reduced storage).
Refund Window: After converting to a paid subscription, you have 14 days from the date of your first payment to request a full refund. To initiate a refund, contact support@tiidon.com with your account email and subscription details.
Refund Process: Refund requests are processed within 5 business days. Refunds will be issued to the original payment method in the currency you were billed.
Post‑Refund Access: Upon refund, your account will be downgraded to the Growth free tier. You will retain view‑only access to previously created Content for 30 days, after which it may be deleted per our data retention policy.
Exceptions: Refund requests made after the 14‑day window may be granted at Tiidon’s sole discretion in cases of technical issues or extraordinary circumstances, subject to review.
Your Rights: You retain all intellectual property rights and ownership in and to any Content you upload, submit, create, or otherwise make available through the Service (“User Content”).
License to Tiidon: By providing User Content, you grant Tiidon Group a worldwide, non‑exclusive, royalty‑free, fully paid-up, sublicensable, and transferable license to host, store, reproduce, distribute, modify, display, and perform the User Content solely to provide, improve, and promote the Service.
Moral Rights: To the extent you have any moral rights in your Content, you waive such rights to the fullest extent permitted under applicable law.
Responsibility for Content: You represent and warrant that you own or have all necessary rights, licenses, consents, and permissions to use and authorize Tiidon to use your Content, and that your Content does not infringe any third-party rights or violate any laws.
Removal of Content: You may delete your Content at any time via your account dashboard. Tiidon may retain cached or archived copies for operational and legal purposes. Tiidon reserves the right to remove or disable access to any Content that violates these Terms or is otherwise objectionable, without liability.
Feedback: If you submit feedback, suggestions, or ideas regarding the Service, you grant Tiidon an unrestricted, perpetual, irrevocable, royalty‑free license to use and incorporate such feedback into the Service without compensation to you.
Data Backup: Although Tiidon performs regular backups, you are responsible for maintaining local copies of your User Content to prevent data loss.
When using the Service, you must not engage in any of the following prohibited activities:
Illegal Activities: Use the Service to upload, store, publish, or distribute any content that violates applicable laws, regulations, or third‑party rights (e.g., copyright, trademark, privacy).
Security Violations: Attempt to probe, scan, exploit, or test the vulnerability of any Tiidon system, network, or application, or violate any security or authentication measures.
Malicious Code: Upload, transmit, or distribute viruses, worms, trojans, ransomware, spyware, or any other malicious or harmful code.
Denial‑of‑Service: Initiate any form of denial‑of‑service (DoS) or distributed denial‑of‑service (DDoS) attack against the Service or its infrastructure.
Interference: Interfere with or disrupt the integrity or performance of the Service, or access the Service in order to build a competitive product or service.
Unauthorized Access: Attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service.
Reverse Engineering: Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying ideas, or algorithms of the Service.
Spam & Unsolicited Communications: Use the Service to send spam, bulk unsolicited messages, or harass other Users.
Impersonation: Impersonate any person or entity, including Tiidon employees, or falsely state or misrepresent your affiliation with any person or entity.
Automated Tools: Use bots, scrapers, or other automated means to access or interact with the Service without Tiidon’s prior written consent.
Tiidon Group is committed to protecting your privacy and the security of personal data. Our Privacy Policy provides full details, including:
Data Collection: Types of personal data we collect (e.g., name, email, billing information, usage metrics) and how it is obtained.
Purpose of Processing: Why we process personal data—for account management, service delivery, billing, analytics, marketing, and legal compliance.
Data Storage & Security: Where data is stored (Zambia, UK, UAE, Nigeria), security measures (256‑bit SSL, encryption at rest, regular backups), and retention periods.
User Rights: Your rights under applicable laws—access, correction, deletion, portability, objection—and how to exercise them (e.g., contacting privacy@tiidon.com).
Third‑Party Processors: Use of subprocessors (e.g., cloud hosting, payment gateways) acting under confidentiality and data protection agreements.
Cross‑Border Transfers: Transfers of personal data between jurisdictions (Zambia, the EU/UK under UK GDPR & EU GDPR, UAE, Nigeria) with appropriate safeguards (Standard Contractual Clauses, local adequacy decisions).
Children’s Data: The Service is not intended for children under 13. We do not knowingly collect data from minors.
Data Breach Notification: In the event of a data breach, Tiidon will notify affected Users and regulators as required by applicable law within required timelines (e.g., 72 hours under GDPR).
You are responsible for ensuring your use of the Service and any User Content you upload complies with all applicable data protection and privacy laws governing your users’ personal data.
Tiidon Group prioritizes the confidentiality, integrity, and availability of your data. We employ a multi‑layered security approach compliant with industry best practices and international standards, including ISO/IEC 27001 and PCI DSS where applicable. Key measures include:
Data Encryption In Transit & At Rest: All data transmitted between your browser or app and Tiidon’s servers is encrypted using TLS 1.2+ (256‑bit SSL). Sensitive information stored within our infrastructure (e.g., user passwords, payment details) is encrypted at rest using AES-256.
Network & Perimeter Security: We utilize next‑generation firewalls, intrusion detection and prevention systems (IDPS), and DDoS mitigation services to protect our networks from unauthorized access, attacks, and flooding.
Access Controls & Authentication: Administrative access to production systems requires multi‑factor authentication (MFA), role‑based access control (RBAC), and least privilege principles. All internal access is logged and audited regularly.
Secure Development Lifecycle: Our engineering teams follow secure coding standards, conduct regular code reviews, and perform static and dynamic application security testing (SAST/DAST) to identify and remediate vulnerabilities before release.
Regular Backups & Disaster Recovery: We perform automated daily backups of critical data, stored in geo‑redundant locations. Our disaster recovery plan is tested quarterly to ensure minimal downtime and data loss in the event of a major incident.
Vulnerability Management & Patch Management: We continuously monitor for security advisories and apply patches to operating systems, databases, and third‑party components within defined service‑level windows.
Security Monitoring & Incident Response: 24/7 security operations center (SOC) monitoring, real‑time alerting, and a formal incident response process ensure that any suspected breach is investigated and contained promptly. We commit to notifying affected Users and regulators within required legal timelines (e.g., 72 hours under GDPR).
Physical Security: Our data centers and cloud providers maintain strict physical controls, including biometric access, video surveillance, and on‑site security personnel.
Third‑Party Audits & Certifications: We engage independent auditors to perform annual penetration tests and security audits. Summary reports and high‑level findings are made available upon request under an NDA.
User Responsibilities: While Tiidon implements robust safeguards, you are responsible for maintaining local copies of your Content, using strong passwords, enabling MFA for your Account, and following security best practices on your devices and networks.
Tiidon is engineered for reliability and backed by structured support tiers. Below is an overview of our Service Level Objectives (SLOs) and support commitments:
Uptime Commitment: We target 99.9% monthly uptime for all paid plans, measured across all core platform services (website builder, hosting, APIs, and app launch functionality). Scheduled maintenance windows (typically Sunday 02:00–04:00 UTC) are not included in uptime calculations and will be announced at least 48 hours in advance.
Support Tiers:
Growth Plan: Email support during business hours (Monday–Friday, 08:00–18:00 Lusaka time). Initial response within 24 hours.
Professional Plan: Priority email and live chat support 7 days a week, 08:00–20:00 Lusaka time. Initial response within 4 hours for urgent issues.
Enterprise Plan: 24/7 dedicated support hotline and ticket queue. Guaranteed initial response within 1 hour and access to a Technical Account Manager (TAM) for proactive monitoring and quarterly architecture reviews.
Incident Management: All support requests generate a ticket in our incident management system. You can track status updates, view incident reports, and receive post-mortem summaries for critical outages.
Self‑Service Resources: Comprehensive documentation, knowledge base articles, API references, and community forums are available at docs.tiidon.com for on-demand assistance and best practices.
Escalation Path: For unresolved or high‑impact issues, escalate via your account dashboard or contact your TAM (Enterprise) to invoke our formal escalation procedure, ensuring executive-level attention and rapid resolution.
Service Credits: In the event we fail to meet the uptime SLO, eligible paid subscribers may receive service credits calculated on a pro‑rata basis as described in your Subscription Agreement.
Feature Requests & Feedback: Submit product feedback or feature requests through the “Feedback” widget in your dashboard or via product@tiidon.com. While not guaranteed, we review and prioritize requests based on impact and feasibility.
Tiidon respects the intellectual property rights of others and expects Users to do the same. If you believe that any material available through the Service infringes your copyright or other intellectual property rights, please provide our Copyright Agent with a written notice containing the following information:
Identification of the copyrighted work claimed to have been infringed, including a description of the original work.
Location of the infringing material on the Service, including URLs or specific descriptions sufficient for Tiidon to locate the content.
Your contact information, including full name, mailing address, telephone number, and email address.
Statement of good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
Statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
Physical or electronic signature of the copyright owner or authorized representative.
Send notices to our designated Copyright Agent at: legal@tiidon.com. Tiidon will respond promptly to remove or disable access to the allegedly infringing material and may terminate repeat infringers’ accounts in accordance with our policy and applicable law.
These Terms remain in effect until your Account is terminated. Termination may occur as follows:
By You: You may cancel your Subscription at any time via your Account Settings. Cancellation takes effect at the end of your current billing period. All paid features will cease, and your Account will revert to the Growth free tier.
By Tiidon for Cause: Tiidon may suspend or terminate your Account and access to the Service immediately if you:
Materially breach these Terms or the Privacy Policy and fail to cure within 14 days of notice.
Engage in prohibited conduct under Section 8.
Fail to pay fees within 30 days of the due date.
Infringe third‑party intellectual property rights repeatedly.
Effects of Termination:
Your right to use the Service immediately ceases.
Tiidon will delete or anonymize your User Content and data 30 days after termination, except as required to comply with legal obligations.
Any prepaid, unused fees are non‑refundable, except as mandated by applicable law or Tiidon’s refund policy (Section 6).
Survival: Provisions regarding ownership, indemnification, disclaimers, limitation of liability, and governing law survive termination or expiration of these Terms.
No Warranties: THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON‑INFRINGEMENT. TIIDON DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR‑FREE, OR COMPLETELY SECURE.
Use at Your Own Risk: You assume all risk associated with your use of the Service and any consequences thereof, including loss of data or unauthorized access, even if Tiidon has been advised of the possibility of such damages.
Limitation of Liability: IN NO EVENT SHALL TIIDON GROUP, ITS AFFILIATES, LICENSORS, OR THIRD‑PARTY PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF TIIDON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Liability Cap: TIIDON’S AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO TIIDON FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Third‑Party Services: Tiidon is not responsible for any third‑party services, plugins, or content integrated into or accessed through the Service. Any transactions or disputes with third‑party providers are between you and the third party.
State Law Rights: Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. If these provisions are unenforceable in your jurisdiction, Tiidon’s liability will be limited to the fullest extent permitted by law.
Indemnification: You agree to indemnify, defend, and hold harmless Tiidon Group and its officers, directors, employees, and agents from any claims, liabilities, damages, judgments, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your breach of these Terms, your Content, or your use of the Service.
Tiidon may update or revise these Terms of Service from time to time to reflect changes in our business practices, legal requirements, or technological advancements. When we make changes, we will follow the process outlined below:
Advance Notice: For material changes (e.g., new fees, changes to refund policy, major feature deprecation), we will provide at least thirty (30) days’ notice via email to the address on file and prominent in‑app or dashboard notifications.
Minor Updates: Non‑material changes (e.g., clarifications, formatting, minor policy adjustments) may be effective immediately upon posting without advance notice. We will indicate the “Last Updated” date at the top of these Terms.
Acceptance: Your continued access to or use of the Service after the effective date of the updated Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must cancel your Subscription and cease all use of the Service prior to the effective date.
Historical Versions: Archived versions of prior Terms will be retained and made available at tiidon.com/terms/archives for reference.

These Terms shall be interpreted and governed under the laws of the Republic of Zambia, without regard to its conflict of law principles. Notwithstanding the foregoing, Tiidon Group may, in its discretion, elect to bring or defend any claim or legal action arising under these Terms in the courts of the United Kingdom (for matters relating to Tiidon Cloud Limited), the United Arab Emirates–Dubai (for matters relating to our Dubai office), or Nigeria (for matters relating to our Nigerian affiliate).
Negotiation: In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service (“Dispute”), the parties shall first attempt in good faith to resolve the Dispute through informal negotiation for at least thirty (30) days.
Arbitration: If the Dispute cannot be resolved by negotiation, either party may submit it to final and binding arbitration administered by the Zambia International Arbitration Centre (ZIAC) under its rules, with the seat of arbitration in Lusaka, Zambia. The number of arbitrators shall be one, appointed in accordance with ZIAC rules.
Alternative Forums: If either party elects not to arbitrate or the Dispute is ineligible for arbitration (e.g., injunctive relief), the parties agree that the courts of Lusaka, Zambia shall have exclusive jurisdiction.
Waiver of Class Actions: All Disputes must be brought on an individual basis; class actions, collective actions, or representative actions are not permitted.
Jury Trial Waiver: To the maximum extent permitted by law, each party waives any right to a jury trial in any judicial proceeding arising out of or relating to these Terms.
Interim Relief: Either party may seek interim or preliminary injunctive relief in any court of competent jurisdiction to protect its confidential information or intellectual property pending resolution of the Dispute.
